Pre-Contract Information Form

English translation: the Turkish version of this document is binding and prevails in case of any difference.

In force and last updated: Version 2.3

All legal documents

The Pre-Contract Information Form contains the legal information that must be given to you before you purchase a service from inurdemirel.com as a consumer. Here you will find who the seller is, the main characteristics of the service, the total price including taxes, the payment and performance conditions, your right of withdrawal, how you can end monthly packages and where you can submit your complaint. You must read and confirm this form before the contract is concluded; without confirmation, the contract is not concluded and no payment is requested from you. You may withdraw within 14 days from the day the contract is concluded, without giving any reason. When approving the order, you request that the service be started without waiting for this period; your right of withdrawal ends when the service begins. Before the service begins, you may request that the start be postponed to the end of the withdrawal period; in this case your right of withdrawal lasts for the full 14 days.

Purpose and scope of the form

This form has been prepared pursuant to Law No. 6502 on Consumer Protection and Articles 5 and 6 of the Distance Contracts Regulation. It contains the information that must be provided to the consumer before the contract is concluded for services purchased remotely through inurdemirel.com and the client panel www.inurdemirel.com/panel.

The Form applies to natural or legal persons (consumers) who purchase the service for non-commercial or non-professional purposes. The Commercial Service Agreement applies to legal persons who purchase the service for commercial or professional purposes and to natural persons who are merchants, tradespeople or self-employed professionals.

Whether the buyer is a consumer or a commercial buyer is determined by the invoice type selected at the payment step. A buyer who selects the individual invoice type is deemed a consumer; this Form, the Distance Sales Contract and the right of withdrawal apply. The Commercial Service Agreement applies to buyers who, by selecting the corporate invoice type, have the invoice issued in the name of their company, business or self-employed professional activity and who confirm that they are purchasing the service for commercial or professional purposes. In unclear cases, the buyer is deemed a consumer. The statutory consumer rights of a buyer who in fact purchases the service for non-commercial or non-professional purposes are not removed because of this selection.

All of the parties’ rights and obligations are set out in the Distance Sales Contract. If there is any discrepancy between this form and the contract, the provision in favour of the consumer applies.

Complaints and requests may be submitted using these contact details or through the support request section of the client panel. Notices of withdrawal and termination, however, are given through the written channels listed in the “How to exercise the right of withdrawal” and “Order cancellation and termination of the contract” sections.

Card payments are, as a rule, collected through the Seller’s group company Shofix OÜ (Narva mnt 5, 10117 Tallinn, Estonia; Estonian trade registry code 17321116), and the invoice for these orders is issued by Shofix OÜ. In this case too, the party to the contract is the Seller; the service and the Seller’s obligations towards the consumer do not change. This form applies to sales made by the Seller whose details are given above. Other information about the company is set out on the Legal Information page.

Main characteristics of the services

The Seller offers the following services in the field of digital marketing and software. The scope, content, duration and price of each service are shown on the relevant service page. For bespoke work, this information is set out in the written quotation.

ServiceMain characteristicPricing method

They can be purchased monthly without a commitment term or with a 3, 6 or 12-month commitment term.Monthly package price; prices are shown including VAT (20%). For purchases with a commitment term, a discounted monthly price applies according to the chosen term, and this price is fixed for the commitment term. The corporate scope is determined by written quotation.

For purchases with a commitment term, the monthly price is fixed for the commitment term. The advertising budget and expenses outside the package are not included in the price.
Custom softwareBusiness-specific software and integration projects whose scope is determined after an analysis meetingDetermined by written quotation

The service is purchased with the characteristics shown on the service page or in the quotation and in the order summary at the time of the order. All services are carried out on a bespoke basis; the consumer’s website, accounts and objectives are taken as the basis.

Results such as search engine rankings, traffic, number of followers or sales are not guaranteed. These results depend on the algorithms of search engines and platforms, the work of competitors and the changes the consumer makes on their own site. If the service page additionally contains a written guarantee, that guarantee applies under the conditions stated on the page.

For web design and custom software work, the server, software and browser requirements for running the software to be delivered are stated in the quotation. Technical protection measures such as a licence key, if any, are also shown in the quotation.

For web design and custom software work, the consumer may use the site or software for which they have paid indefinitely, in accordance with its purpose. The other conditions of the right of use are stated expressly in the quotation: whether the source code will be delivered, the authority to modify and transfer, and third-party licences, if any.

For social media services, the accounts and the content published with the consumer’s approval belong to the consumer.

Total price, taxes and additional costs

Service fees are set in Turkish lira. The total price including all taxes payable by the consumer is shown in the order summary before the order is approved. The consumer does not pay more than this amount. If instalment payment by card is selected, the total amount payable is shown separately, together with the instalment charge, in accordance with the “Payment methods and invoicing” section.

Prices shown to consumers on the service pages include VAT; the amount excluding VAT is shown only for information, next to the VAT-inclusive price. The total price in the order summary cannot exceed the VAT-inclusive price shown on the service page. For services sold by written quotation, the price appears in the quotation and in the order summary including taxes.

For packages billed monthly, two amounts are shown separately in the order summary: the price including taxes for each billing period and, for purchases with a commitment term, the total price payable over the commitment term.

Unless otherwise stated in the quotation, bespoke quotations are valid for 7 (seven) days from the date on which they are issued. A quotation that is not approved within this period does not bind the parties.

The Seller may change the prices and conditions on the service pages with effect for the future. Except for the monthly packages without a commitment term described below, changes apply only to orders placed after the date on which they are published. The price of approved one-off orders does not change. For monthly packages with a commitment term, the monthly price remains fixed for the commitment term.

For monthly packages without a commitment term, a price change is notified to the consumer by e-mail at least 30 days before it takes effect; the price cannot be changed without this notice. The consumer may terminate the contract without paying any additional fee before the change takes effect.

Since the services are performed digitally, there is no shipping or delivery fee. The Seller does not charge the consumer separately for the use of means of distance communication. Internet and telephone usage costs are subject to the standard tariff of the consumer’s own operator.

For social media packages, the advertising budget is not included in the package price. The advertising budget is paid directly to the advertising platform from the consumer’s own advertising account and with the consumer’s own payment method.

The advertising budget approved by the consumer may exceed the monthly managed-budget cap stated on the service page and in the order summary. In this case, a management fee equal to 10% of the excess spend is invoiced separately, with VAT added.

The following costs are not included in the social media package price: licensed music and stock footage, model, venue and studio hire, props, drone filming and content creator fees. These costs, and additional services whose price is stated on the service page, are invoiced only on the following condition: the amount including taxes is notified to the consumer in advance and the consumer’s explicit approval is obtained.

During performance, an additional cost may arise that was not foreseen within the scope of the order but is necessary to continue the work. The Seller notifies the consumer of this cost together with its justification and amount. The additional cost is not collected, and is not paid on the consumer’s behalf, without the consumer’s explicit approval.

If the consumer does not accept the additional cost, the service is completed within its existing scope. If this is not possible, the consumer chooses one of two options: terminating the contract with the price of the work completed and delivered to them deducted, or requesting a refund of the full amount collected. The refund is made within 14 days from the date on which the consumer notifies their choice.

If the quotation provides for an advance payment or deposit, its amount, the time of payment and the refund conditions are shown clearly in the quotation and in the order summary.

Payment methods and invoicing

Payment can be made by one of the following methods:

  • Bank transfer (havale or EFT): The Seller’s bank account details are provided to the consumer during the order.
  • Credit card: Card payment is collected through the Seller’s group company Shofix OÜ via Revolut; where Revolut cannot be used, it may be collected via PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş. (PayTR), a payment and electronic money institution licensed in Türkiye. Card details are entered on the payment institution’s secure payment page and are not stored by the Seller.
  • Balance: Payment can be made with balance loaded to the account in the client panel. Loaded balance is not refunded and can be used only for orders on the site; this point is shown separately, and the consumer is asked to approve it, before balance is loaded.

Payment is requested after the consumer has confirmed this form and the contract texts. Performance of the service begins after the first payment has been collected. If the quotation provides for a payment plan, payments are made according to that plan. For monthly packages, the price is paid for each billing period before the period begins: the price of the first period is paid with the order, and the price of subsequent periods is paid upon a request sent by e-mail before each period begins. Periods are one month each from the day the service begins; the payment dates are shown in the client panel when the service begins.

Orders placed with payment by bank transfer (havale or EFT) are processed once it is verified that the amount has reached the Seller’s account. If the amount does not reach the Seller’s account within 7 days from the order date, the order is cancelled and no amount is requested from the consumer. For card payment, if the payment is not completed, no order is created.

Instalment payment by card: The instalment option can be used only for orders where payment is collected via PayTR and to the extent offered by the card issuer; the number of instalments is selected on PayTR’s secure payment page. At the payment step and in the order summary, the cash price, the number of instalments, the instalment amount, the instalment charge and the total amount payable are shown together for each instalment option. The instalment charge is calculated according to the payment institution’s instalment rates on the order date and is payable only if the consumer chooses instalment payment; there is no instalment charge for a single payment.

An invoice is issued in the consumer’s name for each payment. For orders whose payment is collected through our group company Shofix OÜ, the invoice is issued by Shofix OÜ; the party to the contract is still the Seller. Discounts such as discount coupons, gift wheel rewards and the loyalty discount are subject to the Campaign Terms; only one discount applies per order, and it is shown in the order summary.

Placing the order and conclusion of the contract

An order can be initiated in the client panel (www.inurdemirel.com/panel) by adding the service to the cart from the service pages on inurdemirel.com, or by a WhatsApp message, e-mail or telephone call opened through the links on the service pages. A membership account is required to place an order from the client panel. Whichever channel the order is initiated from, the contract is concluded through the following steps:

  1. The consumer notifies the Seller of the service they wish to purchase or of the written quotation sent to them, or creates it as an order in the client panel. Whether the purchase is a consumer transaction or a commercial transaction is recorded with the purchase purpose declared at the payment step and the invoice type selected (individual or corporate); in unclear cases, the purchase is deemed a consumer transaction.
  2. Before requesting payment, the Seller sends the consumer the order summary, this form, the Distance Sales Contract and the Cancellation, Refund and Withdrawal Terms on a durable medium, by e-mail or as a client panel link.
  3. The order summary shows the following information: the seller’s trade name, the service and package, the commitment term if any, the total price including taxes, for monthly packages the price per billing period and the total for the commitment term, the payment method, the delivery period or delivery schedule, and the invoicing and contact details.
  4. The consumer confirms that they have read these texts: by means of a checkbox in the client panel that is not pre-ticked, or by a written reply on a durable medium (for example by e-mail) to the message with which the texts were sent. The contract is concluded with this confirmation.
  5. In the approval text in the client panel, the consumer expressly requests that the service be started before the withdrawal period expires, and is informed in this text that the right of withdrawal will end when performance begins. While the order is at the “Queued” stage, the consumer may, by notice via the client panel or e-mail, request that the service be started after the withdrawal period has ended; in this case the right of withdrawal continues for the entire 14-day period. For orders placed outside the client panel, the early start request is obtained by a separate written declaration.
  6. Payment is requested only after the texts have been confirmed. Before giving confirmation, the consumer is expressly informed that the order entails an obligation to pay; in the client panel, this statement is shown together with the approval button.

Before giving confirmation, the consumer can check the information in the order summary. They can correct incorrectly entered information by returning to the previous steps, or ask the Seller to correct it; the corrected summary is sent to them again. For errors noticed after confirmation, the consumer can contact the Seller via the client panel or e-mail.

The same steps also apply to orders placed without using the client panel, for example through WhatsApp or e-mail correspondence: the texts and the order summary are sent to the consumer’s e-mail address; the confirmation and, if any, the early start request are obtained by written reply. A consumer who uses the client panel opens a membership account and verifies their e-mail address before placing an order.

Receipt of the order is confirmed without delay to the e-mail address provided by the consumer. This form and the Distance Sales Contract are sent to the consumer’s e-mail address together with the order confirmation and are stored in the client panel together with the order.

The consumer can access this form and the Distance Sales Contract that they approved from the client panel for at least 3 years, and may request a copy by e-mail at any time. The Seller retains the contract text and the approval records for the periods provided for in the relevant legislation.

The services are sold only to persons with full legal capacity; transactions on behalf of persons without full legal capacity may be carried out only by their legal representatives. The language of the contract is Turkish.

This section contains the information that must be provided under Articles 3 and 4 of Law No. 6563 on the Regulation of Electronic Commerce.

Start, duration and delivery of the service

If the consumer has not expressly requested that the service be started before the withdrawal period expires, or has revoked this request before performance begins, performance begins after the withdrawal period has ended. In this case, the delivery period begins on whichever is later: the date on which the first payment is collected or the first business day following the date on which the withdrawal period ends. If the consumer has requested early start, the delivery period begins on the date on which the first payment is collected.

Periods are calculated in business days; Saturdays, Sundays and public holidays are not counted as business days. If payment is collected on a day that is not a business day, or after 18:00 on a business day, the period begins on the next business day.

For social media packages, if the consumer selected a start month during the order, the first period begins on whichever is later: the first day of that month or the day determined according to the rules above.

One-off services such as backlink packages are completed within the period stated for the package in the order summary (for example “Within 20 business days at the latest”). The order summary forms part of this form; the period stated in the summary is binding. If no period is stated in the order summary, this period is 40 (forty) business days at the latest.

For web design and custom software projects, the delivery schedule is set out in writing, stage by stage, in the quotation after the discovery or analysis meeting and is shown in the order summary. The dates in this schedule are maximum delivery periods. The periods given for these projects on the sales pages are estimates for information purposes.

For monthly packages, the service is maintained in each billing period throughout the commitment term. The scope of each period is the monthly scope stated on the service page and in the order summary.

The service is performed digitally; no physical delivery is made. For one-off services, the service is deemed delivered when the order is moved to the “Completed” stage.

For monthly SEO and social media packages, the work is reported at the frequency stated on the service page and, in any case, for each billing period. For one-off SEO work, the report is provided at the end of the service. The order status and reports can be followed in the client panel.

Delivered reports and files can be downloaded from the client panel as PDF or Word at delivery and after delivery; keeping a copy is the consumer’s responsibility. The conditions for access to old records in the event of changes to the client panel are set out in the “Notices and retention of records” section of the Distance Sales Contract. Access to this form and the contract is not affected by such changes.

For the service to be performed on time and in full, the consumer is expected to:

  • provide the access details relating to the website, such as FTP, SSH and the site administration panel,
  • provide the necessary content as directed by the Seller and implement the recommended changes,
  • share in advance with the Seller any changes to the URL structure, content, analytics code and file structure that may affect the SEO work,
  • act personally, as the owner of the website that is the subject of the service, as the Seller’s counterpart throughout the process.

Some delays may be caused by the consumer. In this case, the time elapsed from the date on which the Seller’s request is notified to the consumer until the date on which the request is met is added to the delivery period. Delay alone does not result in the price paid becoming non-refundable. However, for projects that have been pending for more than 30 days for reasons attributable to the consumer, the Seller grants a reasonable additional period by giving notice in writing or on a durable medium; if the necessary action is not taken within the additional period either, the Seller may terminate the contract. In this case, the price of the work done and the loss documented by the Seller are deducted, and any remaining amount is refunded within 14 days at the latest (Distance Sales Contract, “Abandoned projects”).

Access details and other personal data are processed solely for the purpose of performing the service and within the scope of the KVKK Privacy Notice. The detailed obligations are set out in the Distance Sales Contract.

Failure to perform the service on time or impossibility of performance

If the Seller does not perform the service within the period it has committed to, the consumer may terminate the contract. In this case, all payments collected are refunded together with statutory interest. The refund is made within 14 days from the date on which the termination notice reaches the Seller, in a single payment and without imposing any cost on the consumer (Distance Contracts Regulation, Article 16).

If performance of the service becomes impossible, the Seller notifies the consumer of this in writing or by e-mail within 3 days from the date on which it becomes aware of it. It also refunds all payments collected within 14 days from the date of the notice.

Order stages

The status of the order is shown in the client panel with the following stages:

Queued
Appears in the client panel as “Pending” or “Brief received”. The order has been received; performance of the service has not yet begun. The order can be cancelled at this stage. Cancellations within the withdrawal period are treated as an exercise of the right of withdrawal.
In Progress
Appears in the client panel as “Work in progress”, “Processing”, “Awaiting approval” or “Delivered”. Performance of the service has begun. This is notified to the consumer by e-mail and in the client panel, together with the date and time. Performance begins either upon the consumer’s early start request or after the withdrawal period has ended; therefore, at this stage the right of withdrawal cannot be exercised, as explained in the “When the right of withdrawal cannot be exercised” section. The consumer’s other statutory rights are reserved.
Completed
Appears in the client panel as “Completed”. The service that is the subject of the order has been performed and delivered.
Cancelled
Appears in the client panel as “Cancelled” or, if the price has been refunded, “Refunded”. The order has been cancelled following the exercise of the right of withdrawal or a cancellation request submitted at the “Queued” stage.

The “Information needed from you” status shown in the client panel indicates that information, content or access is awaited for the service; it does not change whether the order has started, and the provisions of the previous stage continue to apply. The start of performance (“In Progress”) is notified by e-mail and in the client panel together with the date and time.

Right of withdrawal

The consumer may withdraw from the contract within 14 days from the day the contract is concluded. The consumer is not required to give any reason or to pay any penalty for this (Distance Contracts Regulation, Article 9). The day the contract is concluded is the day on which the consumer confirms this form and the Distance Sales Contract.

It is sufficient for the withdrawal notice to be sent to the Seller before this period expires. No cost or fee is requested from the consumer for exercising the right of withdrawal.

When the right of withdrawal cannot be exercised

Pursuant to Article 15(1)(h) of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services whose performance has begun with the consumer’s approval before the withdrawal period expires. The same exception also applies to Google Rank Tracking packages: since the service begins at the moment the payment is confirmed with the separate approval in the cart, there is no right of withdrawal (“Google Rank Tracking annex”, clause 3). No other withdrawal exception is relied on in this form.

In the client panel, the consumer requests early start of the service when approving the order; for orders placed outside the client panel, this request is obtained by a separate written declaration. In this case, the right of withdrawal ends when performance of the service begins, that is, when the order is moved to the “In Progress” stage; the start of performance is notified to the consumer by e-mail and in the client panel together with the date and time. In any case, the withdrawal period is 14 days at the most. If, before performance begins, the consumer gives notice that they want the service to be started after the withdrawal period has ended, performance begins after the withdrawal period has ended and the consumer may exercise the right of withdrawal throughout the entire 14-day period; this notice is free of charge and does not affect the order. Even if performance has begun within the withdrawal period without the consumer’s request, the right of withdrawal continues for the 14-day period.

How to exercise the right of withdrawal

The withdrawal notice is sent to the Seller before the withdrawal period expires. The notice is given in writing or on a durable medium such as e-mail (Distance Contracts Regulation, Article 11). You may use the channels below, and you may also give notice through the written channel through which you placed the order (for example WhatsApp):

  • The support request section of the client panel (www.inurdemirel.com/panel),
  • E-mail: work@inurdemirel.com,
  • Post: Meşrutiyet Mah. Konur Sok. Özsoy İş Hanı No: 25/13, 06420 Çankaya/Ankara.

Processing is easier if the notice includes the consumer’s full name and the order number or order date. The notice may be given in free text. If desired, the sample text in the “Sample withdrawal notice text” section of the Cancellation, Refund and Withdrawal Terms sent to the consumer during the order may be used; using it is not mandatory.

The Seller confirms to the consumer by e-mail that the withdrawal notice has reached it.

Refund of the price

If the right of withdrawal is exercised, the Seller refunds all payments collected from the consumer. The refund is made within 14 days from the date on which the withdrawal notice reaches the Seller (Distance Contracts Regulation, Article 12).

The refund is made in a manner appropriate to the payment instrument used by the consumer and in a single payment. No cost or obligation is imposed on the consumer.

Card payments are refunded to the card used for the payment through the payment institution through which the payment was collected (Revolut for payments collected through Shofix OÜ, PayTR for payments collected with PayTR). The time it takes for the amount to appear on the card account depends on the procedures of the card-issuing bank. Payments made by bank transfer (havale or EFT) are refunded to the bank account from which the payment was made, and payments made with balance are refunded to the balance. For discounted orders, the refund amount is the amount actually paid.

Order cancellation and termination of the contract

Orders at the “Queued” stage, that is, orders whose performance has not yet begun, can be cancelled even if the withdrawal period has passed. In this case, the full amount collected is refunded. The refund is made within 14 days from the date on which the cancellation request reaches the Seller.

Monthly SEO and social media packages are in the nature of subscriptions. The consumer may terminate these contracts without giving any reason and without paying any penalty (Law No. 6502, Article 51).

Notice of termination can be given through the support request section of the client panel, by e-mail or by post; it is not made subject to a stricter form than the method used to conclude the contract. Termination takes effect on the date on which the notice reaches the Seller. If the consumer has specified a later date in the notice, termination takes effect on that date. The Seller processes the termination request within 7 days at the latest from the date on which the notice reaches it.

Only the price of the service performed up to the termination date may be requested from the consumer. The price paid in advance for the days after the termination date is calculated on a daily basis. This amount is refunded within 14 days from the termination date.

For purchases with a commitment term, the commitment term, the monthly price, the discount provided and the method of calculating the maximum amount that may be requested on early termination are shown in the commitment letter given to the consumer on a durable medium. If the contract is terminated before the commitment term expires, the total of the commitment discounts provided up to the termination date (the difference between the monthly price without a commitment term and the monthly price with a commitment term) is requested from the consumer; this amount cannot exceed the total of the monthly prices for the remaining commitment term, and whichever of the two is lower is requested. Only the discount provided for the package with a commitment term in periods that have begun and been paid for is included in the calculation; monthly additional services purchased together with the package are not included in this calculation. The calculation method is shown in the commitment letter; apart from this, no termination fee, withdrawal fee or penalty is requested.

When the commitment term ends, the contract is not renewed for a new commitment term without the consumer’s approval. The continuation of the service on a monthly basis without a commitment term is subject to the consumer’s approval. This option and the price to be applied are notified to the consumer before the commitment term ends. If approval is not given, the contract ends at the end of the commitment term.

For monthly packages, if the price for a period is not paid by the start of the period, the service for that period does not begin and the consumer is notified by e-mail. If the price is not paid within 14 days from the start of the period either, the package is deemed to have ended at the beginning of the unpaid period and no price is requested for the unpaid period. For packages with a commitment term, the early termination condition in the commitment letter applies in this case.

Cases of cancellation and refund other than withdrawal are explained in the Cancellation, Refund and Withdrawal Terms.

These terms do not remove or limit the consumer’s rights under Law No. 6502 and the relevant legislation. These rights include the right of withdrawal, the elective rights relating to defective services and the rights to terminate the contract.

Consumer rights in the event of a defective service

The service may be defective: it may be performed contrary to, or incompletely in relation to, the contract or the characteristics notified on the service page, in the quotation or in advertisements and announcements. In this case, the consumer may exercise one of the following rights (Law No. 6502, Articles 13 and 15):

  • re-performance of the service,
  • free repair of the work resulting from the service,
  • a reduction of the price in proportion to the defect,
  • rescission of the contract.

The consumer’s right to claim compensation under the general provisions is reserved.

Rankings may change after the service has been completed. If this change results from changes the consumer makes on their own site, updates to search engine algorithms or the work of competitors, it does not in itself mean that the service is defective.

Complaints and dispute resolution

Complaints can be submitted through the following channels: the support request section of the client panel, e-mail to work@inurdemirel.com, the telephone number 0850 840 41 74, or a written application to the Seller’s address. The Seller examines the complaint and notifies the consumer of the outcome in writing.

In the event of a dispute, the consumer may apply to the consumer arbitration committee. The application is made within the monetary limits announced each year by the Ministry of Trade. The consumer may choose the arbitration committee at their place of residence or at the place where the consumer transaction was carried out.

For disputes below this limit, applying to the arbitration committee is mandatory. The application can also be made via e-Devlet through the Consumer Information System (TÜBİS).

For disputes exceeding the monetary limit, an application may be made to the consumer court. Applying to a mediator before a lawsuit is filed is a precondition for bringing the action; the exceptions listed in the law are reserved (Law No. 6502, Article 73/A).

The consumer may file a lawsuit at the consumer court at their own place of residence or at the Seller’s place of residence. A provision stating that disputes will be resolved only at the Seller’s place of residence does not apply with respect to the consumer.

Personal data and commercial electronic messages

Information on the personal data processed during the order and the performance of the service is set out in the KVKK Privacy Notice and the Privacy Policy. For card payments, payment data is processed by the payment institution (Revolut or PayTR), as a separate data controller, within the framework of its own obligations. The data necessary for carrying out and reporting on the service, and for the collection and invoicing of orders whose payment is collected through Shofix OÜ, is shared with our group company Shofix OÜ (Estonia); information on this transfer abroad is set out in the KVKK Privacy Notice.

This data is processed without relying on explicit consent. Data necessary for the conclusion and performance of the contract relies on the legal basis of performance of the contract (KVKK Article 5(2)(c)). Data necessary for issuing invoices and retaining records relies on the legal basis of compliance with a legal obligation (KVKK Article 5(2)(ç)).

Placing an order is not conditional on two approvals: giving consent under the Explicit Consent Text and agreeing to receive campaign and promotional messages under the Commercial Electronic Message Consent. These approvals are requested separately from the order and on an optional basis; they can be withdrawn at any time.

The rights relating to personal data can be exercised with the Data Subject Application Form; applications are concluded free of charge.

Confirmation of the pre-contract information

The consumer confirms that they have read this form in the client panel or on a durable medium. The contract is not concluded until this confirmation is obtained (Distance Contracts Regulation, Article 6). Payment is requested only after this confirmation.

The following approval texts are used in the client panel, and none of them is presented pre-ticked. If the order is placed outside the client panel, the consumer gives the confirmation in the first sentence of the texts by written reply; the early start request is obtained by a separate written declaration:

  • Mandatory approval (purchase without a commitment term): “I have read and understood the Pre-Contract Information Form, the Distance Sales Contract and the Cancellation, Refund and Withdrawal Terms. I want the service to be started without waiting for the withdrawal period; I know that my right of withdrawal will end when the service begins and that my order entails an obligation to pay.”
  • Mandatory approval (purchase with a commitment term): “I have read and understood the Pre-Contract Information Form, the Distance Sales Contract, the Cancellation, Refund and Withdrawal Terms and the commitment letter. I want the service to be started without waiting for the withdrawal period; I know that my right of withdrawal will end when the service begins and that my order entails an obligation to pay.”
  • Mandatory approval (if there is a Google Rank Tracking package in the cart, separate box): “I expressly request that the Google Rank Tracking package be started and made available for use at the moment the payment is confirmed. I have been informed that I have no right of withdrawal because the service begins with my approval before the withdrawal period expires (Distance Contracts Regulation, Article 15(1)(h)).”

Approval records are stored together with the date and time of approval and the version of the form. The approved version of the form is sent to the consumer’s e-mail address together with the order confirmation.

Google Rank Tracking annex

This annex applies to Google Rank Tracking packages purchased from the cart and forms part of this form. The Enterprise package is offered under a separate written contract; this annex does not apply to that package.

  1. Nature of the service: Google Rank Tracking is a digital service in which, within the scope of the package purchased, the ranking in Google search results for the domain name and keywords defined by the buyer is measured regularly and the results are presented in the client panel. Depending on the package scope, competitor rankings, AI answer tracking (mentions of the brand in the answers given by Gemini, ChatGPT and Claude to specified questions), Google Maps grid ranking, alerts and reports are provided. Desktop rankings are measured every day, within the top 100 Google organic results; the frequency of mobile measurement and of AI answer tracking is stated on the package page. The entitlements of the packages (keywords, projects, competitors, locations, devices, daily updates, reports) are stated on the package page at the time of the order and in the client panel; the entitlements at the time of the order apply throughout the period.
  2. Term and payment: The service is paid for in advance for the selected period (1, 3, 6 or 12 months); the period begins at the moment the payment is confirmed. There is no automatic renewal; at the end of the period the service ends of its own accord. A reminder is sent by e-mail 7 days and 1 day before the end of the period.
  3. Right of withdrawal: The service begins at the moment the payment is confirmed, at the consumer’s express request. Because the service begins with your approval before the withdrawal period expires, you have no right of withdrawal (Distance Contracts Regulation, Article 15(1)(h)). This approval is obtained in the cart with a separate box that is not pre-ticked; the payment step cannot be reached until the box is ticked. The right of withdrawal does not apply to commercial buyers in any event.
  4. Trial: A free trial may be offered once to members whose e-mail address has been verified: 7 days, up to 20 keywords and 1 project. No payment details are requested for the trial; at the end of the trial the service closes of its own accord. The trial is for information purposes and contains no promise of results.
  5. Package change: When switching to a more comprehensive package, the remaining time of the current period is transferred to the new package as days, in proportion to the packages’ keyword entitlements. Switching to a smaller package takes effect when the current period ends. These operations do not give rise to a refund of payment.
  6. Information on results: Measurements reflect the search engine’s results at the time of measurement, through third-party data providers; search results may vary by location, device, time and personalisation. The service is a measurement and reporting service; no specific ranking, traffic or sales result is undertaken. In the event of a temporary provider-related disruption, that day’s measurement may not be carried out; a day that could not be measured is shown as blank in the client panel.
  7. Fair use: Package entitlements are for the buyer’s own personal or corporate use; attempting to exceed the entitlements by automated tools, transferring the account to others or reselling the service is prohibited. The domain name can be changed at most twice a month per project. In the event of misuse, the service may be suspended.
  8. Data retention: Measurement history is retained for the duration of the service; it is retained for a further 90 days after the end of the period and is deleted if the service is not renewed. Deleted projects are permanently deleted after 30 days. Share links (in the Agency and higher packages) are valid for 30 days and can be disabled by the buyer whenever they wish.
  9. Reports: Reports carry the inurdemirel brand; the report number can be verified on inurdemirel.com.
  10. Gift and trial: The entitlements of the Google Rank Tracking Starter package are assigned free of charge: for SEO packages and SEO consultancy, throughout the paid package period from the date the order is approved; for the Altın, Vip, Elite Master, Elite Leader and Zirve backlink packages (including their versions with on-page SEO), for 90 days from the date the order is completed. For backlink packages, the entitlement is 1 project and as many keywords as the package’s number of target keywords (Altın 3, Vip 7, Elite Master 10, Elite Leader 15, Zirve 20). The project is opened by the buyer in the client panel; location and device are measured according to the buyer’s choice within the entitlements of the Starter package. If the buyer has the same or a more comprehensive Google Rank Tracking package, the gift period runs after that package’s period. The gift and the free trial are free of charge; they do not require payment or withdrawal approval, cannot be transferred, cannot be converted into cash, end of their own accord at the end of the period and do not convert into a paid package. If the main package is cancelled or refunded, the gift also ends; no separate refund of the price is made for the gift. The gift and the trial are for information purposes; they contain no promise of a specific ranking or result. This clause does not limit the consumer’s rights of withdrawal, rights relating to defective services and rights to a refund of the price.
