Purpose and scope of this text
This Commercial Electronic Message Consent governs the commercial electronic messages sent by İnurdemirel Dijital Pazarlama Ve Yazılım Hizmetleri Ticaret Limited Şirketi ("Company"). The text has two purposes: to obtain your consent under Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages ("Regulation"), and to inform you, under Article 10 of Personal Data Protection Law No. 6698 ("KVKK"), about your personal data processed for this purpose.
The text consists of information (privacy notice) sections and, set out separately from them, the Consent statement section. Reading this page does not mean that you have given consent.
Consent is established only when you yourself tick a box that is reserved for this purpose and not pre-ticked, when you give your consent in writing, or when you give consent to the Company through the Message Management System (İYS).
Giving consent is optional. Free analysis requests, the contact form, appointments, purchasing services and client panel membership are not conditional on this consent. Not giving consent does not prevent you from using any service; it does not lead to an additional fee or different terms.
This text covers only commercial electronic messages. The Company's other personal data processing activities are explained in the KVKK Privacy Notice and the Privacy Policy.

For the purposes of Law No. 6563 the Company is the service provider sending the messages, and for the purposes of the KVKK it is the data controller. Messages are sent on behalf of the Company, and each message contains the Company's trade name and the other identifying information required by the legislation.
Intermediary service providers offering e-mail or SMS infrastructure may be used for sending. In this case too, the sender of the message is the Company. Intermediary service providers process your contact details only to send messages on behalf of the Company and in line with the Company's instructions.
Messages that may be sent under your consent
If you give consent, the Company may send you commercial electronic messages, through the channels you have consented to, only with the following content:
- Campaign, discount and special offer announcements
- E-newsletter: content in the fields of digital marketing, SEO and GEO, and announcements relating to the Company's services
- Invitations to events, seminars and webinars
- Promotion and information relating to the Company's services, packages and free tools
- Celebration and greeting messages sent on official and religious holidays and on New Year
Celebration and greeting messages also count as commercial electronic messages under the legislation; they are therefore sent only if you have given consent.
Your consent covers only messages that the Company will send in its own name. This consent does not mean that you allow third parties to send you messages in their own names.
Non-commercial messages and messages exempt from consent
Not every message sent to you is a commercial electronic message. The distinction below shows for which messages your consent is required.
Non-commercial messages. The following messages have no promotional or marketing purpose; they are therefore not commercial electronic messages. They continue to be sent even if you do not give consent or withdraw your consent:
- The reply to the free analysis, contact or appointment request you submitted through a form (including the analysis and offer you requested)
- Order, payment, invoice, delivery and reporting notifications relating to the service you have purchased
- Replies to your support requests
- Verification and security notifications relating to your client panel account
- Notifications made under legal obligations, such as changes to contracts and policies
Messages relating to the use, maintenance and modification of the service. No prior consent is required for messages, sent to the contact addresses you provided to the Company when purchasing a service, that relate to the use, maintenance or modification of the service you purchased (Article 6(1) of Law No. 6563). You may also refuse these messages at any time (Article 8 of Law No. 6563).
Follow-up and reminder messages. Reminder and follow-up messages sent after the reply to your request for the purpose of promoting packages or services are commercial electronic messages and are sent only if you have given consent.
If campaign or promotional content is added to a non-commercial message, the message is treated as a commercial electronic message and is sent only if you have given consent.
Communication channels
| Channel | Contact information used | Means of opting out |
|---|---|---|
| Your e-mail address | The opt-out (unsubscribe) link in every e-mail | |
| SMS (text message) | Your mobile phone number | The free opt-out instruction in every message |
The Company does not make campaign or promotional phone calls; consent is therefore not requested for phone calls.
Consent is given per channel, and a separate consent box is offered for each channel. Messages are sent only through the channels you have consented to; no commercial electronic message is sent to you through a channel you have not consented to.
Obtaining consent and the Message Management System (İYS)
The Company obtains your consent only through consent boxes that are reserved for this purpose, not pre-ticked and offered per channel, in writing, or through İYS. The consent box links to this text on the form or screen where it is offered. Leaving the box empty does not prevent you from submitting the form or using the service.
If consent is requested together with a service contract, it is offered as an optional choice separate from the contract terms. Accepting the contract does not mean that you have given consent to commercial electronic messages.
Browsing the site, scrolling the page, submitting a form without ticking the consent box, or remaining silent does not count as consent.
When you give your consent through the forms on the website, the client panel or another electronic means, information confirming that your consent has been received is sent, together with an option to refuse the consent, to the electronic contact address for which you gave consent within 24 hours at the latest. If you did not give the consent yourself, or if you have changed your mind, you can immediately use the opt-out option in this notice.
This notice is not sent separately for consents given directly through İYS.
Together with your consent, the date and time of the consent, the channel through which it was given, the place where it was obtained (for example, the relevant form) and your contact address are recorded. The fact that the consent confirmation notice was sent is also recorded.
Consents obtained directly by the Company are registered in İYS within three business days, as required by the legislation. Consents not registered in İYS are deemed invalid, and in that case no commercial electronic message is sent to you.
Through the İYS website (iys.org.tr) or mobile application, you can see the consents you have given to the Company and to other senders, give new consent or withdraw your consents.
Consent should be given only for contact addresses that belong to you or that you are authorised to use. If it comes to the Company's knowledge that a contact address provided belongs to another person, sending to that address is stopped and the relevant consent record is updated in İYS.
Withdrawing your consent (right to opt out)
You can withdraw your consent at any time, without giving any reason and free of charge. To do so, it is sufficient to use one of the following means:
- In e-mails: the opt-out (unsubscribe) link in every message
- In SMS messages: the free opt-out instruction in every message
- Through İYS: iys.org.tr or the İYS mobile application
- By e-mail: writing your opt-out request to work@inurdemirel.com. If you do not specify a channel in your request, the opt-out is applied to the consents for all channels that you have given to the Company.
Sending through the relevant channel is stopped within three business days at the latest after your opt-out request reaches the Company (Article 8 of Law No. 6563). Opt-out notices submitted directly to the Company are also notified to İYS within three business days.
An opt-out made using the opt-out link or instruction in a message applies to the channel through which the message arrived. If you want to withdraw your consent for all channels, you can state this in your opt-out request or opt out for all channels through İYS.
Opt-out requests that do not specify a channel or whose scope is unclear, for example calling us and stating in general terms that you do not wish to receive messages, are applied so as to cover all channels.
Withdrawing your consent does not affect the lawfulness of messages sent up to the date of withdrawal. Non-commercial transactional and informational messages, however, continue to be sent for as long as our service relationship continues.
Your opt-out record is kept for the period stated in the "Retention period and destruction" section, in order to ensure that no further messages are sent to you and to prove the opt-out.
Messages sent to merchants and tradespeople
Under Article 6 of Law No. 6563, commercial electronic messages may be sent without prior consent to the electronic contact addresses of recipients who are merchants or tradespeople. If the Company makes use of this possibility, it complies with the following rules:
- It uses only your business's publicly available corporate contact addresses or the addresses that your business has provided to the Company in a corporate capacity.
- Information submitted through the forms on the website is not used for this purpose without your consent; a person submitting a form is not presumed to be a merchant or tradesperson.
- Before sending, it registers the relevant address in İYS and checks through İYS whether there is an opt-out notice for the address.
- It determines whether the sending remains within the scope of legitimate interest by means of a balancing assessment, made in writing, between the Company's interest and the fundamental rights and freedoms of the data subjects.
As a merchant or tradesperson, you also have the right to opt out. If you exercise your right to opt out by one of the means above, no commercial electronic message is sent to you unless your consent is obtained again.
Information relating to legal entities is not personal data; however, the first name, surname, e-mail address and phone number of natural-person merchants and tradespeople, business officers and employees are personal data and are processed with the safeguards in this text.
Personal data processed for this purpose and method of collection
| Data category | Data |
|---|---|
| Identity | First name, surname |
| Contact | E-mail address, phone number; if contact is made on behalf of a business, the name of the business |
| Consent and opt-out records | Channels for which consent was given and withdrawn, date and time of the transaction, the place where the consent was obtained (form, client panel, written statement or İYS), record of the sending of the consent confirmation notice |
| Transaction security | Transaction security information (IP address and browser information at the time the consent or opt-out was given) |
| Message sending records | Date, channel and subject of the message sent; opt-out notices submitted |
These data are collected, by automated or non-automated means, through the inurdemirel.com and www.inurdemirel.com/panel forms and screens on which the consent box is offered, İYS, written applications, and the e-mails or phone calls you send or make to the Company.
Where messages are sent without consent to merchant and tradesperson recipients, contact information is obtained from the publicly available corporate sources stated in the section above or from the addresses that the business has provided to the Company in a corporate capacity.
We do not request your special categories of personal data under this text; if you provide them on your own initiative, they are processed only to the extent required by your request and subject to the conditions in Article 6 of the KVKK, and are destroyed if they are not necessary.
Purposes of processing and legal bases
| Purpose | Legal basis under the KVKK |
|---|---|
| Sending commercial electronic messages through the channels you have consented to | Your explicit consent (KVKK Article 5(1)). The consent statement expresses both the prior consent required by Article 6 of Law No. 6563 and your explicit consent limited to this purpose. |
| Sending the consent confirmation notice, registering consent and opt-out records in İYS, and carrying out an İYS check before sending | Fulfilment of a legal obligation (KVKK Article 5(2)(ç); Law No. 6563 and the Regulation) |
| Retaining consent, opt-out and sending records and submitting them to the Ministry of Trade upon request | Fulfilment of a legal obligation (KVKK Article 5(2)(ç)) |
| Proving consent or opt-out in a dispute | Establishment, exercise or protection of a right (KVKK Article 5(2)(e)) |
| Ensuring that no further messages are sent to persons who have opted out | Fulfilment of a legal obligation and legitimate interest (KVKK Article 5(2)(ç) and Article 5(2)(f)) |
| Sending messages relating to the use, maintenance or modification of the service you have purchased | Being directly related to the establishment or performance of a contract (KVKK Article 5(2)(c)). Under Article 6(1) of Law No. 6563, no prior consent is required for sending; your right to opt out is reserved. |
| Where the Company makes use of this possibility, sending messages to the contact addresses of merchants and tradespeople without prior consent | Legitimate interest, subject to a written balancing assessment (KVKK Article 5(2)(f)). The sending is permitted by Article 6 of Law No. 6563; your right to opt out is reserved. |
Withdrawing your explicit consent has the same result as exercising the right to opt out: your contact details are no longer used to send commercial electronic messages.
Transfer of personal data
- İleti Yönetim Sistemi A.Ş. (İYS): for registering and checking consent and opt-out records; fulfilment of a legal obligation (KVKK Article 8(2)(a), Article 5(2)(ç))
- Service providers offering e-mail or SMS sending infrastructure: only for the purpose of sending messages, in the capacity of data processor. The legal basis of the transfer is your explicit consent (KVKK Article 8(1)); for sending without consent to merchants and tradespeople, it is legitimate interest (KVKK Article 8(2)(a), Article 5(2)(f)). A contract containing the data security obligations under KVKK Article 12 is concluded with these service providers.
- The Ministry of Trade and other authorised public institutions and organisations: upon request and to the extent required by the legislation; fulfilment of a legal obligation (KVKK Article 8(2)(a), Article 5(2)(ç))
- Legal advisers and lawyers: in the event of a dispute; establishment, exercise or protection of a right (KVKK Article 8(2)(a), Article 5(2)(e))
Apart from the transfers listed above, your contact information obtained under this text is not passed on to third parties without your consent and is not used for purposes other than those stated in this text (Article 12(2) of the Regulation).
Using this information for targeting on advertising platforms, or sharing it with business partners for their own promotions, is possible only if your explicit consent is obtained separately.
The servers of some of the service providers used for sending are located abroad. These transfers are subject to Article 9 of the KVKK; which data go to which provider and the basis for the transfers are explained in the KVKK Privacy Notice.
If a standard contract is signed, the contract is notified to the Personal Data Protection Authority within five business days from the date of signature. Current recipient groups and transfers abroad, including the transfer to our group company Shofix OÜ (Estonia), which accesses customer data to provide and report on the services, are set out in the KVKK Privacy Notice.
Retention period and destruction
- Your contact details are used to send commercial electronic messages for as long as your consent is valid.
- Consent and opt-out records and records relating to the sending of messages are kept for 10 years from the transaction date (Article 11(3) of Law No. 6563); the consent record is additionally kept for three years from the date on which the consent ends (Article 13(2) of the Regulation), and whichever period expires later applies. Closing your account does not shorten these periods.
- Your opt-out record is also kept for the same periods. Your opt-out status is also recorded in İYS, and an İYS check is carried out before each sending.
- Data whose retention period has expired are erased, destroyed or anonymised in accordance with the Regulation on the Erasure, Destruction or Anonymisation of Personal Data. Records of these operations are kept for at least three years.
If the same contact information is also processed for another purpose (for example, the performance of a service contract), the retention periods for that purpose are explained in the KVKK Privacy Notice.
Your rights under the KVKK
Under Article 11 of the KVKK, you have the following rights:
- To learn whether your personal data are processed
- To request information about it if they have been processed
- To learn the purpose of processing and whether the data are used in accordance with their purpose
- To know the third parties to whom they are transferred domestically or abroad
- To request their correction if they have been processed incompletely or inaccurately
- To request their erasure or destruction within the framework of the conditions in KVKK Article 7
- To request that correction, erasure or destruction operations be notified to the third parties to whom the data have been transferred
- To object to a result to your detriment arising from the analysis of the data exclusively by automated systems
- To request compensation for the damage if you suffer damage due to unlawful processing
You can prepare your application using the Data Subject Application Form. You can submit your application in writing to the Company's address, sign it with a secure electronic signature or mobile signature and send it to work@inurdemirel.com, or write to work@inurdemirel.com from your e-mail address that you have previously provided to the Company and that is registered in the Company's system.
Your application is concluded free of charge within 30 days at the latest.
If your application is rejected, if you find the answer given insufficient, or if no answer is given in time, you may file a complaint with the Personal Data Protection Board within 30 days from the date you learn of the answer and in any event within 60 days from the date of application (KVKK Article 14).
You do not need to make a KVKK application to stop receiving messages; it is sufficient to use one of the opt-out means above.
Relationship with other consents and preferences
The consent in this text is independent of the other consents under the Explicit Consent Text and of the cookie preferences you set under the Cookie Policy.
Allowing the "Marketing" category in your cookie preferences does not replace consent to commercial electronic messages. Nor does giving consent to commercial electronic messages mean that you allow marketing cookies.
Consent statement
The statement below becomes valid when you tick the box reserved for this statement and not pre-ticked on the relevant form or screen, or when you give the statement in writing. Consent is given only for the channels you tick.
I consent to commercial electronic messages containing campaign, discount and special offer announcements, e-newsletters, invitations to events, seminars and webinars, promotion and information relating to the Company's services, packages and free tools, and celebration and greeting messages sent on official and religious holidays and on New Year being sent by İnurdemirel Dijital Pazarlama Ve Yazılım Hizmetleri Ticaret Ltd.
